Florida LiveScan
- Florida requires vendors, entities, or agencies that electronically submit fingerprints for required or permitted criminal history record checks to enter into an agreement with FDLE.
- The LiveScan device must meet FDLE and FBI technical requirements, and some agencies impose additional specifications.
- Florida AHCA Level 2 screenings are initiated through the Care Provider Background Screening Clearinghouse and require fingerprints and a photograph from an approved LiveScan service provider.
- Background check results are sent to the requesting agency or entity, not to the LiveScan service provider or applicant.
Georgia
- Georgia's statewide applicant fingerprinting system is GAPS.
- Effective February 3, 2025, IDEMIA became Georgia's GAPS vendor, and IdentoGO Enrollment Centers perform electronic fingerprinting for the program.
- Businesses seeking Georgia criminal history checks for employment, licensing, or other noncriminal justice purposes must use the GAPS process and obtain the appropriate agency account when required.
- An independent fingerprinting business should not represent itself as a GAPS or IdentoGO enrollment provider unless it has the required authorization or contractual relationship.
Background Screening and FCRA
If the business obtains, assembles, or provides third party background reports used for employment, housing, credit, or other eligibility decisions, the Fair Credit Reporting Act may apply. Employment consumer reports require specific disclosures, authorization, and adverse action procedures. A fingerprinting service that only captures fingerprints is not automatically the same thing as a consumer reporting agency.
